1. Artificial Intelligence Services & Generated Content

The Application utilizes the Google Gemma 4 open-weights large language model to provide automated text, audio, visual, and reasoning capabilities. By using these features, you acknowledge and agree to the following:

  • Nature of Output: Outputs are dynamically generated by artificial intelligence. XSales® Mobility does not guarantee the accuracy, completeness, or reliability of any generated content. You use and rely on all AI-generated content strictly at your own risk.
  • No Professional Advice: The Application’s AI features are intended strictly for informational, creative, or operational workflows. They do not provide, and must not be used as a substitute for professional advice. 
  • User Input Ownership: You retain ownership of the data, text, or prompts you submit to the AI (“Inputs”). You grant XSales® Mobility a worldwide, non-exclusive, royalty-free license to process these Inputs solely to generate your requested outputs and maintain application functionality.

2. Acceptable Use Policy & Prohibited Conduct

You agree not to use the Application, its underlying AI models, or any generated outputs for any unlawful or unsafe purposes. In alignment with open-source ethical safety standards, you are strictly prohibited from:

  • Harm and Deception: Generating content intended to deceive, defraud, defame, harass, bully, or incite violence against individuals or groups.
  • Safety Circumvention: Attempting to override, probe, bypass, or circumvent the application’s built-in safety filters or guardrails.
  • Unauthorized Data Processing: Utilizing the AI features to scrape, harvest, track, or infer sensitive personal identifying information (PII) of individuals without their explicit legal consent.
  • High-Risk Automation: Deploying application outputs to execute high-stakes, unmediated actions that can cause physical, legal, or financial harm without human-in-the-loop oversight.

3. Open Source Licensing & Attributions

The AI functionality in this Application is powered by components originally developed by Google and distributed under the Apache License, Version 2.0 (the “License”).

  • License Compliance: A copy of the Apache 2.0 License, alongside the required copyright notices and attributions from the original creators, is accessible within the application’s legal/credits settings menu. 
  • Trademark Disclaimer: The “Gemma” and “Google” names, logos, and trademarks belong exclusively to Google LLC. The inclusion of open-source weights in this mobile application does not imply any official endorsement, sponsorship, or partnership by Google.

4. Local Processing & Device Resource Utilization

  • On-Device Execution: The AI features in this Application run locally on your mobile device utilizing Google Gemma 4 open-weights. Your prompts, inputs, and the resulting AI-generated outputs are processed directly on your hardware and are not transmitted to or stored on XSales® Mobility external cloud servers.
  • Hardware Demands: Local AI processing requires significant computational power, memory, and battery consumption. You acknowledge that running these features may cause your device to experience increased battery drain, temporary thermal throttling (heating), or reduced performance in other background applications. XSales® Mobility is not responsible for any degradation of device hardware performance or battery health resulting from local model execution.
  • Storage Allocation: The local AI model requires a fixed amount of storage space on your device to host the model weights and runtime files. You are responsible for ensuring your device has adequate storage capacity to download, update, and maintain these local files.

5. Software Updates & Model Weight Modifications

  • Model Updates: XSales® Mobility reserves the right to automatically push updates, safety patches, or optimizations to the local model weights. These updates may alter the behavior, tone, speed, or accuracy of the generated outputs.
  • Reverse Engineering Protection: While the underlying model weights are governed by the Apache 2.0 open-source license, you agree not to decompile, disassemble, or reverse engineer any proprietary wrapper code, application binaries, or custom software layers created by XSales® Mobility to deploy the model within this specific mobile application.

6. Data Privacy & Local Security

  • User Control & Exposure: Because all data remains local to your device, the security of your inputs and outputs depends entirely on your device’s security configuration. XSales® Mobility cannot recover, delete, or wipe your local AI history if your device is lost, stolen, or compromised. You are solely responsible for securing your device against unauthorized access to the application data.

7. Limitation of Liability & Disclaimers

THE AI SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, XSALES® MOBILITY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

XSALES® MOBILITY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE, INABILITY TO USE, OR RELIANCE UPON AI-GENERATED OUTPUTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
